A parent came to Florida Rural Legal Services, Inc. (FRLS) for help after the Social Security Administration (SSA) terminated SSI benefits for their minor child. FRLS is a non-profit law firm that provides free civil legal aid to qualified individuals, families, and vulnerable communities across 13 Florida counties and to farmworkers statewide.
The child had originally qualified for SSI due to a disability which met the Social Security guidelines. However, after SSA determined the condition had improved, they attempted to cease benefits even though the child was now diagnosed with additional disabilities.
A FRLS attorney brought the case before an Administrative Law Judge and argued that the combination of impairments still functionally qualified the child for SSI benefits. The judge agreed and reinstated the benefits. While the child was not eligible for retroactive payments because benefits had not fully ceased, the parent will continue to receive $488 per month, helping cover expenses related to the child's medical conditions.
