Transportation Safety for Farmworkers and H‑2A Workers

March 24, 2026

Transportation is a daily part of life for many farmworkers and H‑2A workers. Whether you are traveling to the fields, to employer‑provided housing, or to appointments, your safety on the road matters. Unfortunately, transportation‑related accidents are one of the leading causes of injuries and fatalities among agricultural workers. Many of these incidents are preventable when employers follow the law. Understanding your transportation rights can help you stay safe and recognize when something is wrong.

What Safe Transportation Must Include

If your employer provides transportation, the vehicle must:

  • Be insured
  • Be in safe working condition
  • Have a licensed driver
  • Have proper seating
  • Have working seatbelts
  • Not be overcrowded
  • Not transport workers in unsafe truck beds

These rules apply to vans, buses, trucks, and any other vehicle used for worker transportation.

Why These Rules Matter

Unsafe transportation has led to:

  • Serious injuries
  • Heat‑related emergencies
  • Overcrowding accidents
  • Workers being thrown from vehicles
  • Fatal crashes

These tragedies are preventable when employers follow safety standards.

You Have the Right to Speak Up

If you feel unsafe in a vehicle, you have the right to raise concerns.

Your employer cannot punish you for reporting unsafe transportation.

Transportation safety is not a luxury — it is a legal requirement. Every worker deserves to travel safely to and from the job. If you are being transported in unsafe vehicles or feel pressured to ride in dangerous conditions, Florida Rural Legal Services, Inc. (FRLS) may be able to help. Your safety matters, and you do not have to face these issues alone.
