What Is an Injunction for Protection?
An injunction for protection, commonly referred to as a restraining order, is a court order designed to protect individuals from abuse, harassment, or threats. In Florida, there are several types of injunctions, but one of the most common is the injunction for protection against domestic violence. This order can provide immediate safety measures such as prohibiting contact, removing the abuser from a shared residence, and granting temporary custody of children.
Who Can File for an Injunction?
You may file for an injunction if you are a victim of domestic violence or if you have reasonable cause to believe you are in imminent danger of becoming one. Domestic violence under Florida law includes physical harm, assault, battery, sexual assault, stalking, kidnapping, or any other criminal offense resulting in injury or death committed by a family or household member.
How to File for an Injunction
Filing begins at your local courthouse. The clerk will provide you with the necessary forms, and you will be asked to provide detailed information about the abuse and why protection is needed. Once the petition is filed, a judge may issue a temporary injunction that lasts up to 15 days until a full hearing is held. At the hearing, both parties may present evidence before the judge decides whether to issue a permanent injunction.
