A parent came to Florida Rural Legal Services, Inc. (FRLS) for help after their infant child’s disability benefits were at risk. FRLS is a non-profit law firm that provides free civil legal aid to qualified individuals, families, and vulnerable communities across 13 Florida counties and to farmworkers statewide.
The child originally qualified for SSI, but SSA argued he no longer met the criteria. However, because of his original disability, he had developed additional serious conditions. A FRLS attorney represented the child at his disability hearing and argued that the combination of these impairments continued to meet Social Security’s disability standards. The Administrative Law Judge agreed and issued a favorable decision.

Because of this ruling, the child’s parents were awarded $15,056 in retroactive benefits, plus ongoing monthly SSI benefits of $967, along with Medicaid coverage to help manage his medical needs.
