In a previous case, our client entered into a stipulation with the landlord. A stipulation is a written agreement between the landlord and tenant that sets out specific terms both sides must follow such as payment plans, deadlines, or responsibilities to avoid eviction or resolve a dispute.
Recently, the client contacted Florida Rural Legal Services, Inc. (FRLS) again to report that the landlord was threatening eviction due to unpaid rent and that the landlord was violating the terms of the stipulation. FRLS is a non-profit law firm that provides free civil legal aid to qualified individuals, families, and vulnerable communities across 13 Florida counties and to farmworkers statewide.

Our client told FRLS that he was up to date with his rent payments and needed our help to fight back against the unfair eviction. Upon review of the ledger provided by the landlord, we found the landlord was double charging rent to the client each month since the stipulation.
FRLS contacted the landlord to have the rent ledger corrected and to remind the landlord of its ongoing duty to comply with the stipulation, including the notice requirements for inspections. The landlord did not file an eviction complaint and updated the ledger to show the correct balance, which allowed our client to remain in his home.
