A client came to Florida Rural Legal Services, Inc. (FRLS) seeking guidance regarding her teenage son, who has experienced ongoing challenges at school related to special education services, disciplinary actions, and the implementation of accommodations. FRLS is a non-profit law firm that provides free civil legal services to qualified individuals, families, and vulnerable communities across 13 Florida counties and to farmworkers statewide.
The client shared concerns about her son's educational performance, mental health, repeated disciplinary removals, and lack of access to the supports he needs to succeed in school. She believed the school was failing to properly implement his 504 Plan and behavioral supports and questioned whether her son was receiving a Free Appropriate Public Education (FAPE), the legal standard that ensures students with disabilities receive the educational services and accommodations necessary to make meaningful academic progress.
Her son had received multiple out-of-school suspensions and received several weeks of in-school suspension. During those periods, he did not have access to his school-issued computer and was not provided accommodations necessary to complete his schoolwork. These repeated disciplinary actions raised concerns about whether appropriate supports were being provided and whether district policies were being followed.
The client had attended several meetings with school officials to discuss the issues and had already filed a Due Process complaint seeking clarification regarding the disciplinary citation code used by the school and whether it was accurate and appropriate under district policy. As she prepared to move forward, she sought legal guidance to better understand her rights, evaluate her options, and make informed decisions.
A FRLS advocate worked closely with the client to review her case and gather supporting documentation. The advocate provided advice regarding the due process procedures, helped the client understand the strengths and limitations of her claims, and carefully reviewed a proposed resolution agreement before she signed it.
With this guidance, the client was able to move forward with greater confidence and a clearer understanding of her rights and the protections available to her son.
