(SOUTHWEST, Fla.)- Florida Rural Legal Services (FRLS), a non-profit law firm, has partnered with the American Red Cross to provide free legal disaster services to qualified victims in the Southwest region who are struggling to rebuild their lives. FRLS is here to offer free legal assistance in several crucial areas, including:

  • Insurance Claims
  • Proof of Ownership
  • Home Repair Contracts
  • Contractor Disputes
  • Construction Liens
  • Property Disputes
  • Disaster Benefits
  • Document Replacements (such as new advanced directives or other legal papers lost during the storm)
  • Navigating Limitations and FEMA Assistance

On September 29, 2022, FEMA declared a major disaster for Florida, offering direct federal individual assistance for specific counties, including Charlotte, Collier, DeSoto, Hardee, Hillsborough, Lee, Manatee, Pinellas, and Sarasota.

In the months following a declared disaster, homeowners may require help understanding housing-related issues tied to homeowner's insurance, FEMA assistance, repair/rebuild options, and foreclosure avoidance. For renters, comprehending options when a residence is damaged, understanding the landlord's responsibility for repairs, submitting a renter's insurance claim, and seeking government assistance for employment and food benefits may be crucial.

FRLS aims to ensure that low-income individuals have equal access to the courts. By partnering with the American Red Cross, FRLS can not only provide free disaster recovery legal services but also assist in identifying additional aid resources for those in need.

"Don't hesitate to seek legal advice as you navigate the intricate landscape of natural disaster recovery," said Sueanna Jones, Outreach and Community Lawyering Director. "FRLS is ready to assist you with any questions or concerns you may have during this challenging time."

 DEALING WITH CONTRACTORS

When a disaster strikes, many civil legal issues can arise. Hurricane Ian victims should be wary of opportunistic scammers. Unscrupulous individuals posing as contractors can exploit your vulnerability and abscond with your money. Among these deceptive actors are purported roofers, carpenters, and plumbers who, instead of aiding in recovery, contribute to millions of dollars in fraudulent claims reported to the state.

To shield yourself, it's crucial to understand the proper steps when hiring a contractor for property repairs. Watch for red flags indicating potential scams, and remember that legitimate contractors offer free estimates. If a company demands payment for an estimate, consider it a warning sign and seek services elsewhere. Never disclose personal or financial information, such as insurance or social security numbers, to avoid potential misuse by dishonest contractors.

Opt for secure payment methods, like checks or credit cards, steering clear of cash transactions to maintain a documented record for potential payment disputes. When selecting a contractor, prioritize licensed, local, reputable, bonded, and insured professionals. Before commencing work, request to see their state or local license, ensuring it carries a unique number. Note down this license number and verify its legitimacy by contacting the appropriate licensing authority.

If your property suffered from a natural disaster and you possess home and/or flood insurance, consider filing an insurance claim to assess coverage for damages. Community Legal Services can assist you in navigating the claims process, explaining available coverage options, and helping you sidestep costly errors and delays as you rebuild your life.
